In the UK, limited reuse of copyrighted material may fall under fair dealing provisions, including:

• Maintaining open communication channels
CTR’s operational aim is high uptime and reliable access, but this cannot be absolute.

SECTION 20

This section sets out the full extent of CTR Secure Training’s legal liability to learners, employers, customers, and platform users. These terms are compliant with UK contract law, the Consumer Rights Act 2015, the Supply of Goods and Services Act, and relevant Awarding Organisation regulations.
CTR’s training services involve regulated qualifications, practical skills, and digital systems; therefore clear liability boundaries are essential to ensure fairness, operational integrity, and legal protection for all parties.
________________________________________

CTR Secure Training does not exclude liability where doing so would be unlawful.
CTR remains liable for:
• Death or personal injury caused by CTR’s negligence

All other liabilities are subject to strict limitations as outlined below.
________________________________________

• How learners apply skills outside the course
• Misuse of physical or self-defence techniques
• Incorrect use of first aid or medical guidance
• Wrongful or unlawful application of security procedures
• Misinterpretation of training content
• Actions taken by learners in professional or personal settings
Learners must ensure they:
• Follow the law
• Adhere to employer policies
• Use judgement appropriate to real-world scenarios
Training does not replace professional legal, medical, or operational advice.
________________________________________
20.9 No Liability for Certification Delays
CTR is not responsible for certification delays caused by:
• Awarding Organisation processing times
• External quality assurance sampling
• Learner failure to provide ID
• Payment delays
• LMS or system outages
• Incomplete assessments
• Learner malpractice investigations
Delays do not entitle learners to refunds or compensation.
________________________________________
20.10 No Liability Where Learner Does Not Meet Assessment Standards
CTR cannot guarantee:
• Passing exam results
• Competence sign-off
• Compliance with AO criteria
• Approval for certification
Failure to meet assessment standards is not grounds for a refund or compensation.
Additional charges may apply for:
• Re-sits

________________________________________
20.11 No Liability for Losses Arising from Termination or Suspension

CTR commits to:
• Applying these limitations ethically
• Protecting learner welfare
• Delivering high-quality training
• Acting transparently in all decisions
• Considering exceptional circumstances fairly
However, limitations are necessary to:
• Protect the integrity of regulated training
• Ensure compliance
• Maintain operational viability
• Prevent abuse of the system
________________________________________
SECTION 21
21. No Waiver of Rights
This section clarifies that CTR Secure Training’s failure to enforce any part of these Terms & Conditions at any time does not mean that CTR waives its legal rights or accepts non-compliance. This is a standard legal provision used to protect training providers and maintain contractual clarity.
________________________________________
21.1 No Waiver Due to Non-Enforcement
If CTR Secure Training does not immediately enforce any clause, condition, or requirement within these Terms & Conditions, this shall not:
• Be interpreted as a waiver
• Affect CTR’s ability to enforce that clause at a later time
• Limit CTR’s rights under the agreement
• Create an expectation that the clause will not be enforced in the future
CTR retains full enforcement rights at all times.
________________________________________
21.2 No Waiver Through Course Delivery
CTR’s decision to allow a learner to:
• Continue training despite administrative issues
• Use systems during an investigation
• Attend sessions pending ID verification
• Access assessments while a payment is processing
Does not waive CTR’s ability to:
• Terminate the learner’s access
• Enforce outstanding payments
• Withhold certification
• Apply disciplinary or malpractice procedures
• Require immediate rectification of compliance issues
CTR may still enforce all Terms retroactively.
________________________________________
21.3 No Waiver Through Staff Decisions
No trainer, assessor, tutor, administrator, or contractor has authority to:
• Modify these Terms verbally
• Waive any contractual right
• Grant exceptions without formal written approval
• Override Awarding Organisation or regulatory requirements
Only authorised directors of CTR Secure Training may issue a written waiver, and only when explicitly documented.
________________________________________
21.4 No Waiver of Rights in Cases of Malpractice or Misconduct
CTR’s choice to allow a learner to continue training temporarily during an investigation:
• Does not waive CTR’s right to take disciplinary action
• Does not guarantee continuation on the course
• Does not guarantee assessment completion
• Does not prevent suspension or disqualification
• Does not entitle the learner to a refund
CTR retains the right to take any necessary action once the investigation concludes.
________________________________________
21.5 Waiver Must Be Explicit and in Writing
A waiver is only valid if:
1. It is issued in writing
2. It is signed by an authorised CTR director
3. It specifies which clause is being waived
4. It defines the duration or circumstances of the waiver
Any verbal or implied waiver is not legally binding.
________________________________________
21.6 Partial Enforcement Does Not Limit Full Enforcement
CTR may enforce some parts of the Terms at certain times without enforcing others.
This does not:
• Limit CTR’s rights
• Change the meaning of the Terms
• Prevent enforcement of previously unenforced clauses
• Void or weaken any contractual clause
All Terms remain valid and enforceable in full.
________________________________________
SECTION 22
22. Previous Terms & Conditions
This section clarifies how the current Terms & Conditions interact with any earlier versions that may have been issued by CTR Secure Training. This prevents disputes regarding which version applies at the time of enrolment, training delivery, or certification.
________________________________________
22.1 Supersession of Previous Terms
These Terms & Conditions supersede all previous versions issued by:
• CTR Secure Training
• TRISAT
• CTR Secure Services Limited
• Any affiliated or subsidiary training divisions
This includes:
• Website terms
• Printed or PDF terms
• Terms included in earlier course materials
• Terms circulated during past training programmes
• Any previous versions published electronically
Only the current version, as published on the CTR website or LMS, is enforceable.
________________________________________
22.2 Where Previous Terms May Still Apply
Older Terms & Conditions may only apply in the following limited situations:
1. A learner enrolled under a previous version AND
2. A formal contract or written agreement explicitly stated the old version would remain in force.
In these cases:
• CTR will honour the previously agreed Terms for that specific booking
• Any new bookings are governed by the current version
If no such written contract exists, the current version applies automatically.
________________________________________
22.3 Conflicts Between Current and Previous Terms
If any conflict arises between:
• The current Terms & Conditions
• Any earlier terms found in emails, brochures, contracts, or archived training documents
Then:
The current Terms & Conditions take priority and shall prevail.
Earlier versions may not be used to challenge or override the current Terms unless CTR has provided explicit written agreement to do so.
________________________________________
22.4 Archived Versions
CTR may retain archived versions for:
• Internal compliance
• Awarding Organisation audits
• Legal reference
• Historical tracking
These archives do not constitute valid or enforceable terms unless explicitly agreed in writing.
________________________________________
22.5 Learner Responsibility to Review Terms
Learners are responsible for:
• Reviewing the current Terms before booking
• Checking for updates to the Terms if they access ongoing or long-term courses
• Ensuring they understand the Terms that apply to their enrolment
CTR will notify learners of significant changes affecting compliance or assessment processes, but routine updates may be posted without individual notifications.
________________________________________
22.6 No Reliance on Outdated Website Copies or Screenshots
Screenshots, cached pages, or stored copies of older website terms:
• Are not legally binding
• Must not be relied upon
• Cannot override the current Terms
Only the live version on CTR’s official website or LMS is authoritative.
________________________________________
SECTION 23
23. Third Party Rights
This section ensures clarity regarding who has legal rights under this agreement. It protects both CTR Secure Training and learners by confirming that only the parties directly involved in the contract can enforce or rely on these Terms & Conditions.
________________________________________
23.1 No Third-Party Beneficiaries
Unless expressly stated otherwise, no person or organisation other than:
• CTR Secure Training (CTR Secure Services Limited), and
• The learner or organisation purchasing the service
has any rights under these Terms & Conditions.
This applies even if:
• A third party pays for the course
• A third party benefits indirectly from the training
• A learner is taking the course on behalf of an employer
The agreement only creates rights for CTR and the enrolled learner or contracting organisation.
________________________________________
23.2 Exclusion Under the Contracts (Rights of Third Parties) Act 1999
To avoid ambiguity, CTR expressly states:
These Terms are NOT intended to confer rights on any third party under the Contracts (Rights of Third Parties) Act 1999.
This means:
• Third parties cannot enforce these Terms
• Third parties cannot sue under these Terms
• Third parties cannot claim entitlement or benefits
Unless CTR provides explicit written consent.
________________________________________
23.3 Exceptions for Awarding Organisations
Awarding Organisations (AOs) may indirectly rely on parts of these Terms because:
• CTR must comply with AO rules
• AO standards may be referenced within these Terms
• AO investigators and auditors may require access to learner data and assessment evidence
However:
This does not grant the Awarding Organisation rights to enforce these Terms as a contracting party.
Their involvement is regulatory, not contractual.
________________________________________
23.4 Exceptions for Employers in Corporate Bookings
Where a business pays for employee training, the employer may:
• Receive updates on attendance and performance
• Request information for compliance
• Receive invoices, certificates, or progress updates
However:
• They cannot enforce these Terms unless explicitly contracted
• Their rights are limited to payment and reporting arrangements
• They cannot override or amend CTR’s policies without written agreement
________________________________________
23.5 No Rights for Learner Representatives or Family Members
Family members, guardians, friends, or representatives (unless legally authorised through power of attorney) cannot:
• Enforce these Terms
• Demand access to personal or assessment information
• Amend learner bookings
• Override data protection restrictions
All communication must be between CTR and:
• The learner themselves, or
• The authorised contracting organisation.
________________________________________
23.6 Third Party Access Does Not Create Third Party Rights
Where third parties access parts of CTR operations, such as:
• IT providers
• Hosting providers
• Payment processors
• PlagaScan and AI-detection systems
• Quality assurance auditors
• Regulatory inspectors
This does not:
• Create contractual obligations toward them
• Grant them enforceable rights under these Terms
• Make them beneficiaries of the agreement
Their involvement is operational, not contractual.
________________________________________
23.7 Explicit Written Agreement Required for Any Exception
The only time a third party may gain rights is when:
1. CTR agrees explicitly in writing,
2. The agreement is signed by a CTR director, and
3. The scope of the third party’s rights is clearly specified.
This is extremely rare and typically limited to formal corporate contracts.
________________________________________
SECTION 24
24. Communications & Notices

Where the employer funds a course:
• CTR will send attendance, progress, and performance updates to the employer
• Employers may receive copies of certificates (if agreed)
• CTR may request additional information from the employer for compliance
• All decisions regarding cancellations or substitutions must come from an authorised company representative
Learners agree to this structure as a condition of employer-funded training.
________________________________________
24.8 Security & Data Protection in Communications
CTR uses secure systems for:
• Certificate dispatch
• Exam registrations
• Assessment records
• Learner data
• Plagiarism and AI detection reports
However, learners must also:
• Avoid sending sensitive documents over unencrypted email

CTR may refuse to process insecure or incomplete submissions.
________________________________________
24.9 CTR Right to Record Communications
For quality assurance, compliance, and protection, CTR may record:
• Emails
• Support interactions

All recordings will be handled in compliance with GDPR and internal policies.

CTR will not act on such messages.

SECTION 25
25. Governing Law & Jurisdiction (United Kingdom)
This section defines the legal framework that governs these Terms & Conditions and clarifies which courts have authority over any disputes. For a UK-based training provider delivering regulated qualifications, this section protects both CTR Secure Training and learners by ensuring clarity, consistency, and legal certainty.
________________________________________
25.1 Governing Law
These Terms & Conditions, and all contracts formed under them, shall be governed by and construed in accordance with the laws of the United Kingdom, specifically:
• The laws of England and Wales, and
• Applicable UK regulations relating to training, qualifications, and consumer protection.
Relevant legislation may include—but is not limited to:
• Consumer Rights Act 2015
• Data Protection Act 2018 / UK GDPR
• Education Act 2011 (as applicable to regulated training)
• Equality Act 2010
• Health and Safety at Work Act 1974
• Contracts (Rights of Third Parties) Act 1999
• Awarding Organisation regulations and Ofqual requirements
CTR Secure Training operates fully within these legal frameworks.
________________________________________
25.2 Jurisdiction
You and CTR Secure Training agree to submit to the exclusive jurisdiction of the courts of England and Wales for the purpose of:
• Resolving disputes
• Enforcing these Terms
• Handling contractual disagreements
• Interpreting legal obligations
• Considering all claims arising from training or assessment
This applies to:
• Individual learners
• Corporate clients
• International students
• Employers funding staff training
Even if the learner is based outside the United Kingdom, the jurisdiction remains England and Wales.
________________________________________
25.3 Location of Services
CTR provides training services:
• Physically within the United Kingdom
• Digitally via systems hosted in the UK or in GDPR-compliant territories
• Under UK regulatory oversight
Therefore, all training contracts formed with CTR are deemed to be made in the United Kingdom, regardless of the learner’s physical location.
________________________________________
25.4 International Learners
For learners outside the UK:
• UK law still governs the contract
• UK courts retain exclusive jurisdiction
• Learners must comply with UK rules relating to qualifications and assessment
• Local laws in the learner’s country may not alter CTR’s contractual obligations
CTR is not responsible for:
• Differences in international qualification acceptance
• Local laws that may affect the learner’s use of CTR training
• Compliance with foreign regulatory bodies unless explicitly agreed
________________________________________
25.5 Alternative Dispute Resolution (ADR)
CTR Secure Training may, at its discretion, consider:
• Mediation
• Internal review
• Informal resolution attempts
However:
ADR is optional and does not replace the agreed jurisdiction of the courts of England and Wales.
________________________________________
25.6 Severability Related to Jurisdiction
If any provision within this section is found to be unlawful or unenforceable:
• The offending clause will be removed or modified
• The remainder of the Terms shall continue in full force
• Jurisdiction will still default to England and Wales
This prevents the entire agreement from being invalidated due to one clause.
________________________________________
25.7 Binding Effect of Jurisdiction Agreement
By:
• Accessing the CTR website
• Booking a course
• Enrolling on training
• Completing assessments
• Using the LMS or eLearning systems

CTR encourages the use of AI for study support only, such as:
• Improving understanding
• Research assistance
• Explaining concepts
However:
❌ AI must never be used to produce, edit, reword, or structure assessment submissions.
Any AI involvement in examinable work is a breach of academic integrity.
________________________________________
26.4 Use of PlagaScan & AI Detection Tools
CTR uses the following tools to ensure authenticity:
• PlagaScan (plagiarism detection)
• AI-content detection models
• Internal pattern analysis

• Use Harvard Referencing Style
• Cite all external sources
• Provide a complete reference list
• Ensure accuracy and consistency

Learner may receive:
• A warning

Learners may appeal a malpractice decision by:
1. Submitting a written appeal
2. Providing evidence or explanation

________________________________________

• Audits and compliance checks
• Sampling learner work and assessments
• Observation of live assessments
• Interviews with tutors, assessors, or learners
• Reviewing data, registers, and evidence

Learners may be contacted or sampled by EQAs.
Cooperation with EQA is mandatory to ensure qualification validity.
Failure to comply may result in:

CTR ensures that all staff involved in training, assessment, and QA:
• Hold appropriate qualifications
• Maintain occupational competence
